About Hobbys.ai: We provide an AI-powered platform for collectors to scan, identify, grade, price, and organize their collectibles, including trading cards, toys, memorabilia, and other items. Our Services include AI analysis, digital collection management, community features, and L.I.S.A. (Legendary Items Search Assistant).

2. Eligibility and Accounts

2.1 Age Requirements

• You must be at least 18 years old to create an account
• Users 13-17 may use the Services with parental consent
• We reserve the right to verify age and terminate accounts that violate age requirements

2.2 Account Responsibility

• You are responsible for maintaining account security
• You must provide accurate and complete information
• You are liable for all activities under your account
• One account per person; no sharing accounts

3. User Content

3.1 Your Content

You retain ownership of all content you upload to Hobbys.ai, including photos and information about your collectibles ("Your Content").

3.2 License to Use

By uploading content, you grant Hobbys.ai a non-exclusive, worldwide, royalty-free license to:

• Host, store, and display Your Content
• Process Your Content through our AI systems for identification and grading
• Share Your Content based on your privacy settings
• Create anonymized, aggregated data for service improvement

3.3 Content Standards

Your Content must not:

• Infringe on intellectual property rights
• Contain illegal, harmful, or offensive material
• Violate the privacy of others
• Be fraudulent or misleading
• Contain malware or harmful code

4. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, incorporated by reference into these Terms, explains how we collect, use, and protect your information.

7. Acceptable Use and Community Guidelines

7.1 Acceptable Use

• Do not impersonate others or create fake accounts

7.2 Prohibited Harassment and Bullying

• No Harassment: Do not engage in repeated unwelcome contact, threats, or intimidation of other users
• No Bullying: Do not engage in aggressive behavior intended to hurt, embarrass, or intimidate others
• No Hate Speech: Do not post content that attacks individuals or groups based on protected characteristics
• No Doxxing: Do not share others' private information (addresses, phone numbers, etc.)

7.3 Prohibited Activities

You may not:

• Use the App for illegal purposes
• Attempt to hack, reverse engineer, or compromise the App
• Scrape or harvest data from the App
• Create multiple accounts for fraudulent purposes
• Circumvent any security measures

8. Intellectual Property Rights

8.1 Hobbys.ai Property

The App and Services, including but not limited to:

• Software code and architecture
• AI models and algorithms (including L.I.S.A.)
• User interface designs and graphics
• Logos, trademarks, and branding
• Documentation and content we create
• Data processing methods and techniques

are owned by Hobbys.ai and protected by intellectual property laws. All rights not expressly granted are reserved.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use our App and Services for personal, non-commercial purposes in accordance with these Terms.

8.3 Restrictions

You may not:

• Copy, modify, or create derivative works of our Services
• Reverse engineer or attempt to extract source code
• Use our AI models or algorithms outside the App
• Redistribute or resell any part of our Services
• Remove or alter any proprietary notices
• Use our Services to develop competing products

10. Disclaimers and Limitations

• Continuous, uninterrupted service
• Error-free operation
• Accuracy of AI assessments
• Security from all threats

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOBBYS.AI SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Lost profits or data
• Damages exceeding $100 or fees paid in last 12 months

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

11.2 Binding Arbitration

PLEASE READ CAREFULLY:

• Disputes will be resolved through binding arbitration, not court
• Arbitration will be conducted by AAA under Consumer Rules
• You waive right to jury trial and class actions
• Small claims court remains available for qualifying claims
• You may opt out within 30 days of account creation by emailing hobbys.artificial@gmail.com

12. General Provisions

12.1 Termination

• You may delete your account at any time through Settings > Account > Delete Account in the app
• Account deletion is permanent and cannot be reversed
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your license to use Services ends immediately
• Provisions that should survive termination will remain in effect

12.2 Changes to Terms

• We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices
• Effective Date of Changes: Updated Terms become effective 30 days after we post them or send notice to users
• Notice of Material Changes: We will provide prominent notice of significant changes through in-app notifications, email (if provided), or website posting
• Continued Use = Acceptance: Your continued use of Services after the effective date constitutes acceptance of updated Terms
• Disagreement with Changes: If you disagree with updated Terms, you may terminate your account before the effective date

12.3 Entire Agreement

These Terms and our Privacy Policy constitute the complete agreement between you and Hobbys.ai, superseding any prior agreements.

12.4 Severability

If any provision is found unenforceable, the remaining provisions will continue in effect.
